In his address at the Mission Accessibility Annual Day, Justice Arjan Kumar Sikri, former judge of the Supreme Court of India, emphasized the paramount importance of empathy and sensitization in the pursuit of disabled rights. He spoke on the topic of “Creating The RPWD Generation From Principle To Practice” and praised the efforts of organizations like Mission Accessibility. Justice Sikri highlighted the dual aspects of disability rights, including the theoretical underpinning and the practical implementation.
In the first part of his discussion, Justice Sikri traced the historical evolution of disability as a human rights concern, both internationally and nationally. He emphasized how disability rights have become a crucial component of the international human rights discourse. He also mentioned the progress made in raising awareness about disability rights compared to several decades ago.
Moving on to the second part, Justice Sikri explored disability rights under the Indian constitution and the interconnection with international legal principles of equality. He discussed the statutory framework that defines the complete spectrum of rights for disabled individuals.
Transitioning into the third segment, Justice Sikri delved into the role played by courts in aligning disability rights with the concept of human dignity. He emphasized the need for effective implementation of rights, as many judgments and directives remain confined to paper.
In the fourth part, Justice Sikri outlined realistic pathways for the attainment of disability rights. He acknowledged the challenges in translating legal provisions into tangible outcomes and emphasized the need for actionable strategies.
Justice Sikri also addressed the need for greater sensitivity among judges and proposed two key strategies. Firstly, he advocated for programs focused on disability rights at judicial academies. Secondly, he proposed the establishment of specialized benches dedicated to disability rights cases.
The event concluded with an Award Ceremony titled “Trailblazers in Accessibility,” where Netflix was awarded for being an “Accessible Private Sector Organization,” Delhi High Court was awarded for being an “Accessible Public Sector Organization,” and Union Bank was awarded for being “A Leading Example of Disabled-Led Change.”
Overall, Justice Sikri’s speech emphasized the need for a fundamental shift in societal attitudes towards persons with disabilities and the importance of practical change in the pursuit of disability rights.
