Court rules in favor of Christian Louboutin in lawsuit against Shutiq
The Delhi High Court has ruled in favor of luxury shoe brand Christian Louboutin in a lawsuit against Indian footwear company Shutiq. The Court found that Shutiq had copied the distinctive designs of Christian Louboutin’s shoes, concluding that the defendant’s products were knock-offs.
Imitation of designs
The Court noted that Shutiq had imitated a large number of designs from Christian Louboutin’s collection, rather than just a few. This imitation was seen as an attempt by Shutiq to pass off its own goods as those of Christian Louboutin.
Undertaking and damages
As a result of the ruling, the proprietor of Shutiq has given an undertaking to not copy or imitate any of the designs of Christian Louboutin’s shoes. Any breach of this undertaking would result in Shutiq being liable to pay a lump sum of Rs.25 lakhs as damages to Christian Louboutin.
Costs and refund
In addition to the damages, Shutiq has been ordered to pay Rs.2 lakhs as costs to Christian Louboutin within four weeks. The Court also granted Christian Louboutin a refund of 50% of the court fees.
