He requested the court to summon the sub-inspector who issued the challan to determine under which Motor Vehicle Act the challan was issued.

Chief Judicial Magistrate’s Order

The Chief Judicial Magistrate found the issuance of the challan objectionable and ordered Inspector Sanjeev Kumar, the Traffic Inspector of Zarifnagar police station, to provide an explanation by March 29.

The magistrate questioned why punitive action should not be taken against the inspector for issuing an illegal challan.
