Court seeks clarification on triability of cabinet notes in Manish Sisodia’s bail pleas
The Delhi High Court has sought clarification on the triability of cabinet notes in the bail pleas filed by Aam Aadmi Party (AAP) leader Manish Sisodia. Sisodia is currently in judicial custody in connection with money laundering and corruption cases related to the Delhi excise policy scam.
Background
A bench of Justices Sanjeev Khanna and SVN Bhatti raised the question during a hearing represented by Additional Solicitor General (ASG) SV Raju, who was representing the Enforcement Directorate (ED) in the case. The court referred to specific constitution bench judgments that barred them from examining cabinet notes.
The bench further questioned whether this restriction applied to Delhi, considering it is a Union Territory. They also highlighted the issue of not being able to delve into what is said in Parliament, which has been referred to a larger bench.
Political party’s involvement
In addition to the cabinet notes, the court also raised the issue of the Aam Aadmi Party (AAP) allegedly being the beneficiary of the money laundering. They questioned why the political party or its office bearers had not been made accused in the case.
The court asked, “A political party is said to be the beneficiary of this, but they are not an accused or impleaded. How do you answer that?”
Continuation of the hearing
The hearing on Manish Sisodia’s bail pleas will continue on Thursday. The court is seeking further clarification on the triability of cabinet notes and the involvement of the Aam Aadmi Party in the money laundering case.
