Dehradun – A recent ruling by the State Consumer Dispute Redressal Commission has established that if a driver lacks the necessary experience to operate a commercial vehicle in mountainous areas, insurance claims may not be honored in the event of an accident. This decision arose from a 13-year-old case involving a road accident.
Case Background
The case involved Ashok Kumar from Dehradun, who had filed a complaint against New India Insurance Company after they denied his insurance claim.
According to Ashok, his passenger vehicle was involved in an accident near Tri Dhara on the Rishikesh-Srinagar route on February 10, 2011. The District Consumer Dispute Redressal Commission initially ordered the insurance company to pay for the vehicle’s repairs, but the state commission overturned this decision.
Key Findings
The State Commission criticized the District Commission’s earlier decision as being impractical. They emphasized that in order to operate commercial vehicles on hilly terrain, the driver must have the necessary experience. In the absence of this experience, the commission ruled that Ashok Kumar was not eligible for the insurance claim.
