Chennai-based Company Moves Supreme Court to Restore Cheating Case Against Latha Rajinikanth
A Chennai-based company, M/s Ad Bureau Advertising Private Limited, has approached the Supreme Court seeking the restoration of a cheating case against Latha Rajinikanth, wife of actor Rajinikanth. The company has filed a special leave petition challenging the order of the Karnataka High Court, which had quashed the cheating case against Latha Rajinikanth on September 8, 2023.
High Court Grants Partial Relief to Latha Rajinikanth
On August 2, 2022, the Karnataka High Court had granted partial relief to Latha Rajinikanth by quashing the cases for cheating and giving false evidence against her. However, the court sustained the forgery case against her. Latha Rajinikanth has also filed another special leave petition against the High Court order to the extent it sustained the forgery case, which is also listed for September 8.
Background of the Case
The case revolves around the allegation that Latha Rajinikanth produced a forged document before a Civil Court in Bengaluru to obtain a media gag order regarding the reporting of a financial dispute over the payments for the 2014 film “Kochadaiiyaan,” directed by Rajinikanth’s daughter, Soundarya Rajinikanth. The complainant, an advertising company, alleged that Latha Rajinikanth had executed a guarantee on behalf of another company, M/s Mediaone Global Entertainment Limited, which failed to fulfill its financial commitments for the film.
Following this, Latha Rajinikanth sought an injunction against 70 news agencies to restrain them from publishing news about the allegations made against her and her family. The injunction was granted in December 2014. Subsequently, the complainant filed a criminal complaint alleging the production of a forged document before the Civil Court in Bangalore to obtain an order of injunction.
High Court’s Decision
At the High Court, Justice M Nagaprasanna quashed the Magistrate’s order to the extent of taking cognizance of false evidence and cheating charges but sustained the order in relation to the offence of forgery. The High Court held that there was no allegation of inducement to part with the property of the complainant, and the Magistrate cannot take cognizance of false evidence and false statement offences on a police final report without a written complaint by the concerned court. However, the High Court did not find grounds to interfere with the charges of forgery in the case.
Supreme Court’s Decision Awaited
The Supreme Court, comprising Justices MM Sundresh and JB Pardiwala, has agreed to hear the special leave petition filed by M/s Ad Bureau Advertising Private Limited challenging the Karnataka High Court’s order. The restoration of the cheating case against Latha Rajinikanth will be determined by the Supreme Court’s decision.
