Supreme Court Dismisses Petition Challenging Denial of Promotion to Judicial Officer

The Supreme Court recently dismissed a petition filed by a judicial officer challenging the decision of the Punjab & Haryana High Court to deny him promotion as Additional District & Sessions Judge. The officer had approached the Supreme Court after his petition was rejected by the High Court.

Background

The officer’s promotion was denied by a six-member Committee of Judges of the High Court, who deemed his judgments to be “below average”. The officer argued that a three-member Committee had evaluated his judgments and refused his promotion, contrary to the requirement of a six-member Committee.

Supreme Court’s Opinion

The Supreme Court bench comprising Justices Hrishikesh Roy and Pankaj Mithal opined that if the suitability of the petitioner for promotion is based on the quality of his judgments, then the decision of the committee to decline his promotion cannot be faulted. The bench dismissed the special leave petition, stating, “When the suitability of the petitioner for promotion is inter alia based on the quality of judgments, no fault can be found with the decision to decline promotion to the petitioner“.
