The AAP-led Delhi government has announced its decision to challenge the termination of services of about 400 private individuals employed by the Delhi Government. Delhi Lieutenant Governor VK Saxena terminated the services, citing non-transparent engagement and lack of mandatory approval. In a statement, the Delhi government accused the Lt Governor of destroying Delhi and acting against the Constitution. It further stated that the decision will be challenged in court as no show cause notice was issued and no explanation or clarification was sought at any stage.
The Lieutenant Governor claims that the appointments did not follow the mandatory reservation policy prescribed by the Department of Personnel and Training (DoPT). Additionally, several of the engaged private persons did not fulfill the eligibility criteria of educational qualification and work experience as laid down in the advertisements for the posts. The veracity of work experience certificates submitted by these private persons was also found to be fudged and manipulated in many cases.
In response to the termination, the Lt Governor’s office has instructed all Delhi Government Departments, Corporations, Boards, Societies, and other autonomous bodies to immediately terminate the engagements of these private persons if the Lt Governor’s or the competent authority’s approval has not been obtained. However, administrative departments have the option to propose detailed cases with proper justification for continuing such engagements.
The AAP-led Delhi government maintains that the terminated private individuals were from top colleges and universities and were doing excellent work in various departments. They were hired following due process and administrative norms. The government also accuses the Lt Governor of illegally acting against the Constitution and purposely paralyzing the Delhi government.
This decision to terminate the services of 400 private individuals employed by the Delhi Government has sparked a legal battle between the AAP-led Delhi government and the Lieutenant Governor. It remains to be seen how the court will rule on this matter.
