– The High Court directed Setalvad to surrender immediately, but the Supreme Court granted a stay on the order for a week.
– Setalvad’s lawyer argued that she had not violated any bail conditions and that the charges against her were yet to be framed.
– The Solicitor General, representing the Gujarat police, opposed Setalvad’s plea for interim relief, stating that she should be treated like any common criminal.
– The Supreme Court bench questioned why Setalvad could not be given relief for one more week and stated that even common criminals are entitled to interim relief.
– The Solicitor General claimed that the Special Investigation Team (SIT) constituted by the Supreme Court to probe the riots cases received pre-typed and pre-signed statements from Setalvad.
– The High Court had stated in its verdict that Setalvad had filed false affidavits and had worked to polarise the people of a particular community.
– Setalvad was arrested on June 25, 2022, and granted interim bail by the Supreme Court on September 2, 2022.
