Background of the Case
The FIR was lodged at the behest of Akshit Agarwal, a leader of Bharatiya Janata Party’s youth wing. Agarwal alleged that Chaudhary made derogatory statements about the Prime Minister during a press conference in Sambhal. Chaudhary reportedly claimed that Modi was involved in a “love affair” or a homosexual relationship with Gautam Adani. The FIR was filed under Sections 153A, 505(2), and 504 IPC, which deal with promoting enmity between different groups and intentional insult with the intent to provoke a breach of peace.
Supreme Court’s Ruling
Chaudhary filed a Special Leave Petition challenging the judgment of the Allahabad High Court, which refused to quash the FIR. The High Court deemed the offense alleged in the FIR as falling within the ambit of Section 153A and Section 505(2) of the IPC, which are cognizable offenses. Therefore, the FIR could not be quashed.
In their ruling, the Supreme Court upheld the decision of the High Court, stating that it was not a fit case for interference at this stage. The law enforcement agency is currently investigating the alleged offenses and will decide on further action once the investigation is complete.
