Supreme Court Refuses to Intervene in Delhi Government’s Firecracker Ban
New Delhi ★The Supreme Court has refused to intervene in the matter of the ban imposed by the Delhi government on firecrackers. The Supreme Court on Friday refused to approve green crackers containing barium salt, which had been banned in 2018 due to its disadvantages.
Firecracker Manufacturers’ Petition Rejected
- The Supreme Court rejected a petition by firecracker manufacturers seeking approval for firecrackers that emit 30 percent less smoke.
- Justice AS Bopanna and MM Sundaresh stated that the court has not accepted the application and violations of the court’s earlier order will be regulated accordingly.
- The petition sought approval for barium-based green firecrackers and requested the lifting of the ban on crackers.
Court’s Response and Reiteration of 2018 Ban
- Senior advocate Gopal Sankaranarayanan, representing the petitioners, requested an early listing of the issue, to which the court responded, “We can only say Happy Diwali.”
- The court reaffirmed its 2018 ban on traditional firecrackers and its directions to curb pollution.
- The bench dismissed two petitions seeking permission for the manufacture and sale of firecracker sticks and barium-containing firecrackers.
- The court reserved its decision on the petition to ban firecrackers containing barium, stating that no distinction can be made between green and non-green firecrackers when the Delhi government has already banned all types of firecrackers.
- The Arvind Kejriwal government of Delhi has recently re-banned the production, sale, storage, and use of firecrackers.
Overall, the Supreme Court’s decision upholds the ban on firecrackers imposed by the Delhi government and reiterates its commitment to curbing pollution caused by traditional firecrackers.
